[align=left][font=宋体][size=14px]丽水11月23日电 (记者 李飞云 通讯员 陈云祺)今天，浙江松阳法院开庭审理了一起利用QQ平台、资金往来累计达5000万元的网络Dubo案件，以Dubo罪判处被告人王某、吴某、黄某、陶某等9人拘役5个月，缓刑6个月至有期徒刑1年不等，并处罚金9万元至18万元不等。

6 t( k. i3 ?6 t 经依法审理查明：王某、吴某等8人于2009年5月至2010年5月期间在互联网上注册了QQ号和通吃游戏帐号，并通过在QQ签名和通吃账号的昵称栏里注明收售“扎啤”广告、联系电话，向玩家承诺回收Dubo赢取的“扎啤”，用手机向玩家发送银行卡短信，教授部分玩家Dubo方法等等方式，组织了丽水、温州两市数百人使用“扎啤”参与通吃游戏，以“牛牛”、“梭哈”等形式进行Dubo。5 s. P! o3 \; X9 W0 c$ B) A! U

王某、吴某等人通过向玩家收、售“扎啤”并从中获利。回收“扎啤”过程中被告人让玩家在通吃酒吧梭哈游戏平台中的某个房间将自己要出售的扎啤一次性押注，然后玩家强行退出该游戏，以此将“扎啤”全部划到被告人的通吃游戏账户中，被告人通过网上银行转账的方式，将现金支付给参赌人。

8 [& w( b% I! _& l/ `7 _ 期间，各被告人使用相关网上银行帐户累计向玩家支付5000多万元人民币，并将收购的“扎啤”全部销售给玩家用于网络Dubo，从中获利3万至7万元不等。9 v3 F3 Z4 X: D

陶某于2010年3月创建“温州甲骨文银商服务群”，并雇佣他人为该QQ群的客服，在明知群内银商间交易的“扎啤”是用于Dubo目的，仍为银商间交易提供担保和跨行间换钱服务，担保金额价值2300万余元人民币，为Dubo资金结算提供帮助。同时，陶某通过在QQ群内为两个游戏公司发布广告获利6万元。2 }: t8 t1 U9 O: o

法人审理认为：王某、吴某、黄某以营利为目的，组织他人在网络上Dubo获取非法利润，被告人陶某为他人Dubo资金结算提供帮助，其行为均已构成Dubo罪。被告人王保莹系累犯，应从重处罚，被告人吴某、黄某、张某、陶某等6人在案发后主动向公安机关投案并交代了基本犯罪事实，系自首，可以从轻处罚。9被告人归案后自愿认罪，认罪态度好，可以酌情从轻处罚。[/size][/font][/align] |
