彩票大奖的奖金，少则几十万上百万，多则几千万上亿元，这未免让人羡慕甚至是眼馋。由于彩票不记名、不挂失的特点，别人的中奖彩票一旦拿在自己手中，这对每个人都是一个考验。事实上，在欲望的驱使下，侵吞他人彩票奖金的事时有发生，这无论是国内还是境外，都概莫能外。- l: M& }( M c9 Z
台湾：私吞奖金9.2亿 夫妻双双蹲监狱
" x8 G' F% t( k0 T/ A. ?: g 2009年7月，台湾“威力彩”开出9.2亿元新台币巨奖，但事后发生彩金得主纠纷诉讼。高雄市一涂姓商人指张姓夫妇受托代购彩券，中奖后私吞彩金。当地检方根据电话记录、短信及测谎结果等证据，认定张姓夫妇意图私吞，依背信罪起诉。高雄地方法院在2010年11月22日分别判处两人2年有期徒刑。9 e5 ` `9 R. s4 P3 U9 z
张姓夫妇原经营乐透彩投注站，涂姓台商因每次返台都向他们投注而与他们相识;之后涂在大陆经商时，就电话委托张姓夫妇代下注。检方指出，2009年5月间，涂姓台商赴大陆前，给了张2000元，并说“投注的号码，会用短信传回来”;事后依号码买了5期都没中。去年7月2日，涂姓台商又请张以先前短信里的两组号码再买3期，结果中了“威力彩”头奖，奖金9.2亿元新台币。中奖后，张姓夫妇于7月8日到中信银行台北总行领奖，将税后7亿多彩金存入张太太账户。而在涂姓台商回台后，两人更加避而不见。最终被涂姓商人告上法庭， 张姓夫妇因此为自己的贪欲付出了2年徒刑的代价。

美国一男子在商店买彩票中了100万美元大奖，而销售员却告诉他只中了2块钱，还煞有介事地给了他2美元后，自己去兑取了巨奖，后来，该男子将销售员告上法庭，终于追回了部分奖金。# E, x' e- K, `3 h
2009年5月29日，Willis在德克萨斯一个名叫幸运食品店的商店里买了几张超级百万彩票，两天后，他拿着彩票让销售员Joshi帮他扫描，看是否中奖，Joshi高兴地告诉他：“中了!2美元……”并装模作样地把2元“奖金”兑给了Willis。殊不知这彩票却值100万美元!当Willis了解了事实真相的时候，Joshi已经兑取了税后75万美元，并逃回了尼泊尔老家。而Willis即刻报警，在法院的帮助下，Willis最终追回了还在Joshi账户里的39.5万美元。

河南：委托站主买彩 奖金却被冒领2 [& B/ j) l. _3 O5 W3 ^5 x- w
2009年，河南新乡市中级人民法院终审作出判决，判决驳回彩票投注站经营者钟某某的上诉，维持原判，即判决钟某某返还程先生双色球第2006099期二等奖奖金386238.4元。
; D* v- U) `- e2 Y3 k8 z 程先生长期在钟某某经营的投注站购买彩票。因他经常在外地工作，所以委托钟某某按其确定的号码代买彩票，并事先将购买彩票的资金交给钟某某。2006年8月24日，程先生投注的一组号码中了双色球二等奖，奖金为482798元。当时程先生远在内蒙古，未及时了解中奖情况。2006年8月26日，钟某某到河南省福利彩票发行中心将税后奖金386238.4元领出。程先生返回后向他索要奖金时，钟某某却拒不返还，程先生无奈将其告上法庭。法院经审理认为，程先生与钟某某之间形成了委托合同关系。其行为属于不当得利，应将此笔奖金给付程先生。
