山东省宁阳县一男子盗取当地彩站500多张即开型彩票。5月14日下午，他和朋友跑到泰安一彩站兑奖被抓了个正着。目前，盗窃嫌疑人张某已经被宁阳县公安局刑事拘留。
: i3 J6 O* A4 m/ X% g! a4 T, r 经审讯，盗票的张某只有20岁，经常买彩票。他发现宁阳县城区一个彩站防盗设施不完善，且房内没有床，断定晚上没人值班。5月13日凌晨，张某用一根钢锯条锯开彩站窗外防盗网，钻进去实施盗窃，盗走5本即开型彩票，共计500多张。( c8 V; x( p; C: J/ p
张某在一家网吧里刮开了奖金值近2000元的彩票，便打电话叫上朋友盛某赶到泰安，想找个彩站兑奖。
; k4 S7 ^8 s/ l+ G8 w ?1 _ 5月14日，在泰安市某彩站里，站主询问两人这么多彩票从哪里来的，张某回答：“是在宁阳买的。”0 x4 d" K1 o3 O9 w
二人没想到，宁阳被盗的彩站早已给泰安市体育彩票中心打了电话，上报彩站被盗，将被盗彩票编号告诉工作人员，后者向泰安各彩站下发了通知。站主仔细查看了这些彩票编号后，发现其中有宁阳丢失的彩票。他以对彩票进行验证为由，稳住二人，然后报警。, G, ~0 P( f6 _+ ?: b) O
由于案发地点在宁阳，泰安市财源派出所将两名嫌疑人移交至宁阳县公安局刑警大队。) b+ J6 J$ I% }8 P) ?5 [
泰安市彩票中心工作人员称，接到被盗站主上报后，中心立刻通过投注机和其他渠道向市辖区所有彩站发出了通知。“[b]一般彩民都是即刮即兑奖，异地兑奖也可以，只要在本省范围内。[/b]”该工作人员说，张某盗彩票去异地兑奖，以为就能顺利拿到奖金。实际上，[b]即开票出库都是有编码的，被盗彩票一看编码就知。[/b] s$ G+ P0 `6 v! I; {3 L; C7 N* E( S
即开票中奖金额1万元以上须到市中心兑奖，20万元以上须到省中心兑奖，这些都需要中奖人持身份证。据悉，泰安市已经实现全市彩站配备兑奖扫描枪。“超过百元的中奖票，我们都建议站主用扫描枪兑奖，防止假票鱼目混珠。”上述工作人员称，扫描枪的使用要交流量费，类似手机上网费，即开机扫描到关机为止，一般一个月10元足够一家彩站用。1 Z2 R6 Z u6 ^: e0 L( O
上海汇盛律师事务所邓亮律师表示，盗窃彩票是以最终的中奖金额来量刑的。张某的情况假如是中奖2000元以上，如在北京，盗窃罪是2000元起刑，起刑将视情节、金额、主观故意、社会影响等因素判处6个月至3年有期徒刑。但由于各地经济发展水平不一样，具体到山东刑期长短还要看山东高院对盗窃罪的司法解释。 |
